Adjudicator Profile
Edward “Ted” Dreyer is a construction lawyer and mediator in Kitchener, Ontario. Ted is an ex-officio director of the Grand Valley Construction Association and the Chair of the Board of Directors of the Council of Ontario Construction Associations.
Set out below is a summary of Ted’s general approach to the adjudication process:
• Ted typically convenes a preliminary meeting with the parties within a couple of days of being appointed to receive submissions regarding the process and fees.
• Notwithstanding the hourly rate posted above, Ted typically charges an hourly rate proportionate to the amount in dispute in accordance with ODACC’s current Fee Schedule.
• Ted interprets the 5-day deadline for the delivery of the Claimant’s documents pursuant to section 13.11 of the Construction Act as something that can be extended with the consent of both parties.
• Ted generally encourages a process that includes an opportunity for reply with respect to issues, evidence or arguments that could not reasonably be anticipated at the time of a party’s initial submissions.
• Ted is generally willing to extend the deadline for a determination with the consent of the parties. If the parties seek a prolonged extension to permit settlement discussions, Ted generally require the parties to pay an interim retainer on a flat fee basis and schedule period check-ins to ensure that the settlement discussions are progressing toward a resolution.
